Narrow Interpretation of California Labor Code’s Administrative Exemption
NCLC filed twice in this case. NCLC first urged review, and then filed on the merits after review was granted. Liberty Mutual Insurance Company is the real party in interest.
In its merits brief, NCLC urged the California Supreme Court to overturn a lower court ruling that dramatically narrowed the exemption for administrative workers under the California wage-and-hour laws. In this case, the California Court of Appeals allowed a class action of claims adjusters to move forward with claims for overtime pay, holding that the claims adjusters are primarily production workers and therefore not exempt from overtime requirements. NCLC argued that allowing the decision to stand would substantially disrupt California businesses and invite massive litigation.
The lower courts decesion was reversed on 12/29/2011.
