NCLC urged the Supreme Court to decide whether a Louisiana state court violated due process when it excused class representatives from proving that plaintiffs detrimentally relied on a tobacco company’s statements about cigarettes. The class in this case is comprised of more than 500,000 smokers in the state of Louisiana, many with disparate claims. In its brief, NCLC argued that plaintiffs must prove reliance on a defendant’s misrepresentations, and that disparate claims may not be aggregated merely because a plaintiff wishes to do so. NCLC warned that allowing this case to continue will encourage other abusive class actions.
