In re Petition for Administrative Stay of Boiler MACT Rules

Emissions Regulations for Industrial and Commercial Boilers

NCLC's Position

NCLC, as part of a broad coalition of 16 trade associations, filed a letter asking the EPA to delay implementation of costly new rules that would require industrial, commercial, and institutional boilers and process heaters to use "maximum achievable control technology" to reduce emissions. The rules would affect a diverse range of business interests, and cost tens of billions of dollars to implement. NCLC warned that a stay is required to prevent businesses from making potentially unnecessary investments while the rules are being reconsidered.

Case Outcome

The EPA agreed to postpone the effective of the rules until the agency has had an opportunity to reconsider, or until litigation challenging the rules has been resolved.

Procedural History

Motion for stay filed 4/27/11. Stay granted 5/16/2011.
