$500 Million Punitive Damages Award

NCLC's Position

NCLC urged the Nevada Supreme Court to hold as unconstitutional a punitive damages award that is 150 times greater than the compensatory damages. The $500 million punitive damages award in this case is the largest in Nevada history, and the decision could affect 230 related lawsuits. In its brief, NCLC argued that the district court improperly excluded evidence pertaining to the defendants' compliance with government and industry standards. NCLC also argued that the ratio of punitive to compensatory damages is far greater than any ratio previously accepted by the district court or appeals court.
