U.S. Chamber urges Wisconsin Supreme Court to review general personal jurisdiction case

August 08, 2016

The U.S. Chamber asked the Wisconsin Supreme Court to grant review to reverse a lower court decision holding that businesses “consent” to general personal jurisdiction wherever they register to do business. According to the amicus brief, subjecting corporations to general jurisdiction in every state in which they are required to register to do business would eviscerate the due process limits on personal jurisdiction recognized by the Supreme Court in Daimler AG v. Bauman (2014)—and could well have the practical result of exposing corporations that do business nationwide to general jurisdiction in all fifty states. The brief warned that the lower court’s decision encourages forum-shopping and will discourage out-of-state companies from investing in Wisconsin.

Kevin M. St. John, John N. Giftos, and Roisin H. Bell of Bell Giftos St. John LLC served as co-counsel for the U.S. Chamber of Commerce on behalf of the U.S. Chamber Litigation Center.
