Urging the California Supreme Court to grant review, NCLC contended that punitive damages awards can be so excessive as to support motions for new trial and motions for reductions in the award itself. Punitive damage awards rendered by impassioned juries are often far beyond the constitutional maximum and should be entitled to minimal respect.
