Eleventh Circuit addresses enforceability of arbitration agreements prohibiting class or collective actions

The Eleventh Circuit affirmed the district court's ruling. The court rejected a host of arguments claiming that the mandatory arbitration provision was not binding, and that it was unenforceable under the Federal Arbitration Act, federal statutory and constitutional law, and Georgia law.

U.S. Chamber files amicus brief

NCLC urged the Eleventh Circuit to affirm the district court’s rulings that a provision in an employment arbitration agreement barring class or collective actions is enforceable. NCLC also urged the court to hold that an alternate dispute resolution process culminating in mandatory arbitration does not violate the policies underlying the federal anti-discrimination statutes, the Fair Labor Standards Act and ERISA.
