NCLC files amicus brief addressing standing to sue under 42 U.S.C. §1981

NCLC urged the Court to overturn a Ninth Circuit ruling that would allow plaintiffs with no actual or proposed contractual relationship with a defendant to sue that defendant for alleged personal injuries caused by that defendant’s alleged breach of a contract with a third party, or by that defendant’s failure to enter into a contract with a third party. Conferring such broad standing to sue under §1981 would flood the courts with litigation by parties who claim to be directly or indirectly injured by a disputed business transaction involving other parties.
