The U.S. Chamber and a coalition of business groups filed an amicus brief in the Maryland Court of Appeal supporting sound interpretation of Maryland’s statute of repose that would have placed more limitations on liability for improvements to real property. Statutes of repose balance the need for a rational outer limit on litigation involving old construction with the interests of those who may become injured by construction deficiencies.
The Coalition for Litigation Justice, Inc., National Association of Manufacturers, NFIB Small Business Legal Center, American Tort Reform Association, and American Insurance Association filed the brief jointly with the Chamber.
Christopher E. Appel and Mark A. Behrens of Shook, Hardy & Bacon LLP served as co-counsel for the amici.
