U.S. Chamber urges California Supreme Court to review wage-and-hour class action

The U.S. Chamber urged the California Supreme Court to grant review to clarify the standards for class certification in meal and rest break cases. The amicus letter argued that the question whether putative class members actually missed any meals or rest breaks to which they were entitled is a liability issue, not a damages issue, and class treatment is inappropriate where that issue does not lend itself to a common resolution. The letter also details the dangers of permitting statistical sampling to preclude individual defenses to liability and damages.
The Chamber filed the letter jointly with the National Association of Security Companies, the California Association of Licensed Security Agencies, and the California Hotel & Lodging Association.
