U.S. Chamber asks California Court of Appeal to review decision on wage statement reporting

The U.S. Chamber filed an amicus brief urging the California Court of Appeal to overturn a superior court ruling that Macy’s violated Section 226 of the California Labor Code by issuing wage statements that reported advanced commission payments at the time they were paid, without making further note of them on subsequent wage statements after they were earned. The brief in support of the petition for writ of mandate argues that the ruling raises concerns about the legality of a widespread practice and creates significant uncertainty for California employers.

The brief was filed jointly with the California Chamber of Commerce.
