U.S. Chamber asks California Supreme Court to review decision on wage statement reporting

March 21, 2017

The U.S. Chamber filed an amicus letter urging the California Supreme Court to review a superior court ruling that Macy’s violated Section 226 of the California Labor Code by issuing wage statements that reported advanced commission payments at the time they were paid, without making further note of them on subsequent wage statements after they were earned. The amicus letter argues that the ruling raises concerns about the legality of a widespread practice and creates significant uncertainty for California employers.

The brief was filed jointly with the California Chamber of Commerce.

Blaine H. Evanson and Neta Levanon of Gibson, Dunn & Crutcher LLP served as counsel for the U.S. Chamber of Commerce on behalf of the U.S. Chamber Litigation Center.
