U.S. Chamber files amicus brief in 911 fees case

The Chamber’s amicus brief argues that the Massachusetts Court of Appeals should affirm the judgment in favor of Verizon New England in a case brought under the Massachusetts False Claims Act (“Massachusetts FCA”). The brief argue that the “tax bar” in the Massachusetts FCA blocks a lawsuit by a relator to enforce the Commonwealth's tax laws; that the Massachusetts FCA does not permit corporate relators to act as whistleblowers; that the “public disclosure bar” in the Massachusetts FCA blocks the lawsuit; and that the relator’s lawsuit failed Rule 9(b)’s pleading requirement.
