Federal district court denies motion to dismiss

March 14, 2022

The U.S. District Court for the Eastern District of Tennessee denied the motion to dismiss, both (1) concluding that complaint alleged plausible direct and reverse false claims under the False Claims Act (FCA) and (2) rejecting argument that the government’s allegation that a company received an overpayment does not impose an immediate duty to repay that is enforceable under the FCA.
