NCLC argued that the state appeals court’s decision affirming a punitive damages ratio of 152:1 is inconsistent with State Farm v. Campbell, and can be based neither on allegations that the defendant’s misconduct cause “potential injury” to non-parties nor on the wealth of the defendant.
